1. Agreement to these Terms
These Terms of Use govern your use of HoldClose, including the mobile app, website, AI features, reminders, subscription features, and related services. By using HoldClose, you agree to these Terms.
2. Eligibility
You must be at least 13 years old to use HoldClose. If you are under the age of legal majority where you live, you should use HoldClose only with permission from a parent or legal guardian where required.
3. What HoldClose does
HoldClose provides tools intended to help you be more intentional about your relationships, including reminders, reflection tools, notes, relationship insights, and optional AI-assisted coaching or prompts. HoldClose does not guarantee any particular relationship outcome.
4. Not professional advice
HoldClose is not therapy, medical care, mental-health treatment, legal advice, financial advice, or other professional advice. AI-generated content and other suggestions may be incomplete or inaccurate. You are responsible for deciding whether and how to act on anything presented by the app.
5. Your content and responsibilities
You are responsible for the information you enter into HoldClose and for using the app lawfully and respectfully. Do not use HoldClose to store, submit, or generate content that you do not have the right to use, that violates another person's rights, or that is unlawful, threatening, abusive, or intended to facilitate harm.
You retain your rights in the content you create or enter. You give HoldClose and its service providers only the limited rights necessary to process that content to provide features you request, such as generating an AI response.
6. AI features
HoldClose may use OpenAI technology to provide AI-assisted features. AI responses are generated automatically and can make mistakes. You should use your own judgment, particularly for sensitive, high-stakes, or emotionally significant decisions.
7. Subscriptions and billing
Paid subscriptions are purchased through Apple's App Store and are subject to Apple's payment, renewal, cancellation, and refund rules. Subscription pricing and available plans may change. Any pricing change that requires notice or consent will be handled as required by Apple and applicable law.
You can manage or cancel an App Store subscription through your Apple account settings.
8. License to use HoldClose
Subject to these Terms, HoldClose gives you a limited, personal, non-exclusive, non-transferable, revocable license to use the app for your own lawful purposes. You may not copy, reverse engineer, resell, redistribute, scrape, or exploit HoldClose except as permitted by law.
9. HoldClose intellectual property
The HoldClose name, logo, software, visual design, written content, artwork, and other product materials are owned by Kris Asleson or the applicable licensors and are protected by intellectual-property laws. These Terms do not grant you ownership of HoldClose intellectual property.
10. Service availability and changes
We may update, modify, add, or remove features as HoldClose evolves. We may also suspend service temporarily for maintenance, security, technical issues, or circumstances outside our control. We do not promise that every feature will always be available or error-free.
11. Apple App Store
If you obtained HoldClose through the Apple App Store, you acknowledge that these Terms are between you and HoldClose, not Apple. Apple is not responsible for maintaining or supporting HoldClose except as required by law or Apple's own terms. To the extent applicable, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the provisions relating to your App Store use.
12. Disclaimer of warranties
To the fullest extent permitted by law, HoldClose is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. We do not warrant that the app will be uninterrupted, perfectly secure, error-free, or suitable for every relationship or situation.
13. Limitation of liability
To the fullest extent permitted by law, Kris Asleson and HoldClose will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of HoldClose, including relationship decisions, missed reminders, lost data, service interruptions, or reliance on AI-generated content.
14. Termination
You may stop using HoldClose at any time. We may restrict or terminate access if necessary to address abuse, fraud, legal requirements, security issues, or material violations of these Terms.
15. Privacy
Your use of HoldClose is also governed by the HoldClose Privacy Policy.
16. Changes to these Terms
We may update these Terms as HoldClose evolves. If changes are material, we will provide notice when required by law. Continued use after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
